The Law Commision has recommended the enactment of a “Marriage and Divorce Registration Act” to be made applicable to the whole of India and all Citizen ir-respective of their religion, Personal law and without any Exception. It is said in a report that only Marriage and Divorce will have to be Registered. Nothing else relavent to this should be Registered. It is something more or less what we do for the Birth and Death Registration. The majority of states have not enacted any general law on marriage registration applicable to all communities. Only some states in India is strictly following this others are not. By this there is a confusion prevailed between the one who goes for Registration and the one who is present in the Office. This is mainly due to the non,Fully Implemented version of this Bill. Similarly for Registration of Divorce,law which provide for any kind of registration of Divorce of that of Muslim and Parsis. All other Marriage registration laws do not provide for the registration of Divorce although it is a socially beneficial Proposition.
